Terms of Offer for Sale

PLEASE READ THESE TERMS CAREFULLY BEFORE MAKING A PURCHASE

1. Business

1. The Website serves as a platform that enables the online sale and purchase of branded merchandise and services (“Services”) offered by various affiliates, registered merchants, vendors, and service providers (“Vendors”). These Services may include—but are not limited to—sale of products, and sale of vouchers redeemable for specific goods or services. The Vendors are the actual sellers and are solely responsible for fulfillment, product quality, and redeeming vouchers purchased by you through the Website.
2. You acknowledge that Moto Joy reserves the right to modify, discontinue, or change any Service at any time without prior notice. Moto Joy may also update procedures, processes, or conditions of purchase to accommodate changes to the Services. You agree that Moto Joy will not be liable to you or any third party for any modification, suspension, or discontinuation of any aspect of the Services.

2. Vouchers

1. In accordance with the Terms of Use on motojoy.in, you may be eligible to purchase vouchers of specific monetary value.
2. Moto Joy facilitates pre-negotiated deals for various products or services at designated prices and locations. Purchase of such vouchers is subject to these Terms of Offer for Sale and any additional terms set by the respective Vendor.
3. Each voucher will include necessary redemption instructions, validity periods, and/or expiry dates. You must redeem the voucher within the stated period. Unless otherwise specified, you are not entitled to credit, exchange, or cashback for unused vouchers. Vouchers are product-specific (e.g., motorcycle accessories, riding gear, luggage, etc.) and cannot be used for any other products/services or combined with other offers or promotions unless explicitly stated.
4. Vouchers once purchased are non-refundable, regardless of whether they are used.
5. Moto Joy and the Vendors are not responsible for lost, misplaced, or destroyed vouchers.

3. Products

1. Through the Website, Moto Joy offers a range of branded products and merchandise at prices agreed with the Vendor. Purchases are subject to these Terms of Offer for Sale and any additional Vendor-specific terms.
2. Moto Joy provides shipping for all listed products as per company policy, which may be revised without prior notice. Any applicable Octroi charges will be borne by Moto Joy.
3. All products are covered by warranties provided by the respective manufacturer or brand. If a product includes a seller warranty, it will be mentioned in the product description.

4. Services

1. You are solely responsible for your actions in using any service purchased. Moto Joy is not liable for consequences arising from misuse or improper use of services.
2. You confirm that you are of legal age to enter into a binding contract and are not prohibited under Indian law from receiving services.
3. Moto Joy is not responsible for any deficiency in payment made toward services purchased on the Website.
4. Moto Joy does not offer refunds for services once purchased, except in cases of errors during purchase or redemption directly attributable to Moto Joy.

5. Pricing Information

1. Moto Joy strives to offer the best possible prices for all products and services on the Website. However, Moto Joy does not guarantee the lowest price across any geography. Prices and availability may change without notice.
2. Despite efforts to ensure accuracy, errors in pricing or product/service information may occur. If a product or service is listed at an incorrect price or with incorrect details:
   • Moto Joy may contact you for instructions, or
   • Cancel the order and notify you.

Moto Joy reserves the right to adjust the price and seek your confirmation before processing. If the order is cancelled after payment has been processed, the full amount will be refunded to the original payment method.

6. Delivery of Products

• Your shipping address and pin code will be verified before payment. If your location is not serviceable by our delivery partners or the Vendor, we may request an alternate address.
• Moto Joy is not responsible for non-delivery in areas outside our delivery network.
• When multiple products are purchased in one transaction, Moto Joy will attempt to ship them together, but this may not always be possible due to product or logistical constraints.
• All items in a single order will be shipped to one address. To ship products to different addresses, separate orders must be placed.

7. Governing Law

1. These Terms of Offer for Sale and your relationship with Moto Joy shall be governed by Indian law, without regard to conflict-of-law principles.
2. All disputes, claims, or differences arising out of these terms or any transactions conducted on the Website shall be subject to the exclusive jurisdiction of the courts in Thrissur, and you consent to this jurisdiction.
